Western Union^® - Apple Products Gift Promotion (“Promotion”)

1. The promoter is Western Union Japan K.K. (Type 2 Funds Transfer Service Provider: Kanto Local Finance Bureau No. 00039) (the “Promoter”).
2. Information on how to be an Eligible Customer and prizes form part of these terms and conditions. Winners agree to be bound by these terms and conditions.
3. Entry is open to residents in Japan aged eighteen (18) years or above who satisfy the entry requirements outlined in clause 5 below (“Eligible Customers”). Employees (and their immediate families) of the Promoter and service providers, marketing agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1^st cousin.
4. This Promotion starts on March 19^th, 2022 (Saturday) at 00:00 (Japan Time) and ends on October 31^st, 2022 (Monday) at 23:59 (Japan Time) (“Promotion Period”).
5. All Eligible participants, who send money from Japan to the Philippines more than twice during the promotion period with the Western Union International Money Transfer Service at Western Union^® Agent locations or using the Seven Bank International Money Transfer Service via Western Union or the Western Union^® International Money Transfer Service via Convenience Stores, can participate in the prize draws (“Qualifying Transaction”). In order to be eligible for this Promotion, participants understand the Terms and Conditions and agree to comply with all details of the Terms and Conditions and apply upon accessing the Promotion website for this Promotion. This Promotion is not applicable to all transactions sent using the Western Union Online services.
6. Each Qualifying Transaction must be made separately and in accordance with these terms and conditions. Regardless of the number of entries, an Eligible Customers may only win once.
7. There will be seven (7) promotion draws for the Monthly Prizes on the following dates: May 15^th, 2022 (for transactions from March 19^th to April 30^th, 2022); June 15^th, 2022 (for transactions from May 1^st to May 31^st, 2022); July 15^th, 2022 (for transactions from June 1^st to June 30^th, 2022); August 15^th, 2022 (for transactions from July 1^st to July 31^st, 2022); September 15^th, 2022 (for transactions from August 1^st to August 31^st, 2022); October 15^th, 2022 (for transactions from September 1^st to September 30^th, 2022); November 15^th, 2022 (for transactions from October 1^st to October 31^st, 2022). There will be totally ninety (90) winners.
8. There will be two (2) promotion draws for the Grand Prizes on the following dates: July 15^th, 2022 (for transactions from March 19^th to June 30^th, 2022); November 15^th, 2022 (for transactions from July 1^st to October 31^st, 2022). There will be totally four (4) winners, randomly selected from among the applicants who send money more than 8 times from Japan to the Philippines and missed the Monthly Prizes.
9. Contents of the Prize will be determined and provided by the Promoter or a third-party provider. The Promoter is not able to entertain to any requests from the winners, such as changes the color, size and version of prizes. Shipment will be arranged by the Promoter or a third-party provider.
10. The winner’ full name will be announced on Malago Forum Facebook page: www.facebook.com/malagocommunity and will also be notified via email registered at the applying time within fourteen (14) business days after the raffle draw. Prizes will be shipped to the winner's address in Japan within seven (7) business days after the winning notification.
11. In the event that any winner cannot be contacted within seven (7) business days after the draw, even if contact was unsuccessful, and all reasonable efforts having been taken to contact the winner, the relevant winner will be deemed forfeited any prize without compensation, and the Promoter reserves the right to conduct a further draw for a replacement winner. If the Promoter cannot deliver the prize due to unknown address or any error in the address provided by the winner, the relevant winner’s entitlement to the prize will be considered as invalid. The prize will be forfeited in favor of the Promoter without compensation to such winner.
12. In the event that prizes become unavailable for reasons beyond the Promoter’s control, the Promoter may substitute with a prize of equal value.
13. The winner(s) shall be responsible for any tax arising for winning the prize. The prizes are provided by a third-party provider, subject to their respective terms and conditions as to product warranty. The third-party provider will be responsible for any matters arising from or in connection with the prizes, services, and/or information they provide in relation to which the Promoter will have no liability whatsoever. Any enquiry or complaint regarding the prizes, services, and/or information should be directed to such third-party provider. The Promoter will not be held liable to the quality and availability of the prizes, services and information provided by the third-party provider, and excludes liability in connection with the Promotion once the winner(s) enjoys any benefit relating to the Promotion of the full extent permitted by law.
14. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties or failures, unauthorized intervention or fraud, vandalism, power failure, natural disasters, acts of God, civil unrest, strikes, infection by computer virus, bugs, tampering, or any other causes beyond the control of Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Customer; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate to give effect so far as reasonably possible to the original intent of this Promotion.
15. Subject to any applicable laws which cannot be excluded, the Promoter and its related bodies corporate and agents associated with this Promotion shall not be liable for any loss, damage or injury suffered or sustained by anyone (including, but not limited to, direct or indirect loss, consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with this Promotion or any prize provided as part of this Promotion.
16. The Promoter collects personal information ("PI") in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to regulatory authorities. Winning is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.westernunion.com/jp/en/legal/privacy-statement.html A request to access, update or correct any PI should be directed to the Promoter.
17. To the extent that there is any inconsistency between these terms and conditions and other marketing materials or collateral produced in relation to this Promotion, these terms and conditions will prevail.
